These Terms and Conditions ("Terms") govern your use of Gallery (the "App"), a photo and video gallery app for Android and iOS operated by Rain Infotech Private Limited ("Rain Infotech", "we", "us" or "our"). By installing or using Gallery, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App.
1. About Gallery
Gallery lets you view, organise, edit and protect the photos and videos stored on your phone. Among other things, you can:
- browse your photos and videos by date, album and favourites, and search them on your phone;
- find photos and videos by describing them with AI search, which runs a local AI model on your phone (optional; the model is downloaded once when you turn it on);
- edit photos, make collages, trim videos, play slide shows and create PDFs;
- move items to Trash, restore them or delete them;
- hide photos and videos in a private vault protected by a PIN or pattern.
Your photos and videos stay on your phone; the App never uploads them. Some features depend on your phone model or operating system version and may not be available on every phone, or may work differently on Android and iOS.
2. Who can use it
Gallery is for personal, non-commercial use. It is not directed at children under 13. If you are under 18, please use the App with the permission of a parent or guardian, who accepts these Terms for you.
3. No account needed
Gallery has no accounts, logins or sign-ups. You do not need to give us any personal information to use it.
4. Licence to use
We give you a personal, non-exclusive, non-transferable, revocable licence to install and use Gallery on phones you own or control, for your own use, under these Terms and the rules of the store you got it from (Google Play or the App Store).
5. Price and ads
Gallery is free to download and use. To keep it free, it shows ads from Google AdMob. By using the App, you agree that ads may be shown to you.
- Ads appear in some parts of the App, but never in the private vault, in the photo editor while you edit, during setup or while you select photos.
- Ads come from third-party advertisers. We don't create them and are not responsible for their content or for any product, service or website they lead to. Any dealings you have with an advertiser are between you and that advertiser.
- How ad information is collected, and how you can turn off personalised ads, is explained in the Privacy Policy.
- You may not interfere with ads, tap ads fraudulently, or use tools that create fake ad views or taps.
6. Premium: subscriptions, free trial and lifetime
- What you get. Premium is optional. It removes every ad in the App, lifts the free limit on the private vault, and extends AI search to your whole library and your vault, for as long as you have it. Everything else in Gallery stays free.
- Plans. Monthly and Yearly are auto-renewing subscriptions: they renew at the end of each period at the then-current price until you cancel. Lifetime is a one-time purchase that does not renew. Prices are the ones the store shows you, including any taxes it applies.
- Free trial. Monthly and Yearly come with a 7-day free trial for people who have not subscribed before (one trial per Google account or Apple ID). The paywall says whether you can still have it. If you do not cancel before the trial ends, the subscription starts and you are charged the price shown when you started the trial. Cancel at least 24 hours before the trial or a renewal period ends to avoid the next charge (the stores may need that time).
- Cancelling. Cancel anytime in Google Play → Subscriptions (Android) or in your Apple ID settings → Subscriptions (iPhone); Settings → Premium → Manage subscription takes you there. Premium stays on until the end of the period you have paid for, then ends. Deleting the App does not cancel a subscription. Buying Lifetime does not cancel a running subscription: cancel it yourself.
- Who sells it. Purchases are made through Google Play (Android) or the App Store (iPhone). Payment, billing, receipts, renewals and refunds are handled by the store under its own terms. We do not see or store your payment details.
- Refunds. Our Refund & Cancellation Policy explains how to cancel and how to ask for a refund. Refunds are paid by the store under its own policy: Google Play refunds or App Store refunds. If a purchase is refunded, cancelled or revoked by the store, Premium ends. This does not affect any right you have under consumer protection law.
- When Premium ends. Nothing you put in the vault is ever removed or locked: you can always view, restore and delete your items. Only adding more than the free limit needs Premium again.
- Restoring. Premium belongs to the Google or Apple account you used. On a new phone or after reinstalling, sign in to the same account and tap Restore purchases (Settings → Premium, or the paywall). Because Gallery has no accounts, a purchase made on Android does not carry over to iPhone, or the other way round.
- Pending payments. If the store marks a payment as pending, Premium starts only once the store confirms the payment.
- Changes. We may change prices. A new subscription price applies to existing subscribers only as the store allows, which may require your agreement; a purchase you have already made is not affected.
7. Your photos and our App
- Your content is yours. Your photos and videos belong to you. Using Gallery gives us no rights to them, and we never receive them.
- You are responsible for your content. You are responsible for what you store, edit and share with the App, and for having the right to do so.
- Keep your own backup. Gallery is a gallery app, not a backup service. Keep your own backup of photos and videos that matter to you.
- The App is ours. Gallery, its design, code, name and logo belong to Rain Infotech Private Limited and are protected by law. These Terms give you no rights to them except the licence in section 4.
8. Acceptable use
You agree not to:
- use the App for any unlawful purpose;
- use the App to store, edit or share content that is illegal, that exploits children, or that infringes someone else's rights;
- copy, modify, sell, rent, sublicense or distribute the App;
- reverse engineer or decompile the App, or try to extract its source code, except where the law allows it;
- remove copyright or ownership notices from the App;
- block, hide or change ads by modifying the App, get around Premium, or create fake ad views or taps.
9. Deleting, edits and the private vault
9.1 Deleting and Trash
- How deleting works depends on your phone. On Android 11 and later, deleted items go to the phone's trash and are removed permanently by the phone, usually after about 30 days. On iPhone, they go to "Recently Deleted" in the Photos app.
- On Android 10 and earlier, deleting is permanent right away. Gallery asks you to confirm first.
- Items removed with "Delete forever" or "Empty" cannot be recovered.
9.2 Edits
- If you save an edit over the original photo, the original is replaced. To keep the original, save the edit as a copy.
- Trimming a video always creates a new video. The original isn't changed.
9.3 The private vault
- The vault protects photos and videos with a PIN or pattern that you choose.
- If you forget your PIN or pattern, the items in the vault cannot be recovered by anyone, including us. There is no way to reset it.
- Deleting an item from the vault is permanent. Vault items don't go to Trash.
- The vault is never included in phone backups or transfers. Uninstalling the App or clearing its data permanently deletes everything in the vault.
- Before you uninstall the App, reset your phone or change phones, move any items you want to keep out of the vault.
10. Third-party services
Parts of the App rely on third-party services and on your phone's own system: Google AdMob for ads, Firebase Analytics for usage statistics, Google Play and the App Store for purchases, and your phone for sharing, the camera, permissions and approval prompts, and a third-party host for the one-time download of the AI search model (see the Privacy Policy). They have their own terms and privacy policies, and we are not responsible for them. See Google's Terms of Service and Apple's Media Services Terms.
11. Disclaimers
The App is provided "as is" and "as available". To the fullest extent the law allows, Rain Infotech Private Limited makes no warranties, express or implied, including that:
- the App will be uninterrupted, secure or error-free;
- the App will work on every phone or every operating system version, including future ones;
- the App will prevent the loss of any photo, video or other data;
- AI search will find every matching photo or video, or only matching ones: its results come from a local AI model and can miss items or include unrelated ones;
- the App is fit for a particular purpose;
- any ad, or any product or service advertised in the App, is accurate or of good quality.
12. Limitation of liability
To the fullest extent the law allows, Rain Infotech Private Limited is not liable for any loss of photos, videos or other data arising from your use of, or inability to use, the App. This includes loss caused by deleting, a forgotten vault PIN or pattern, uninstalling the App or clearing its data, device failure, or changes to your phone's software.
We are not liable for any indirect, incidental, consequential or special damages arising from your use of, or inability to use, the App, even if we were told such damages were possible. Where our liability cannot be excluded, our total liability is limited to the amount you paid for Premium in the 12 months before the claim, if any.
Nothing in these Terms limits liability that the law does not allow to be limited, including liability for fraud or wilful misconduct, or your rights as a consumer.
13. Indemnification
You agree to indemnify and hold harmless Rain Infotech Private Limited, its directors, employees and affiliates from any claim, liability, damage or expense (including reasonable legal fees) arising from:
- your breach of these Terms;
- content you store, edit or share with the App, including any claim that it infringes someone else's rights;
- your use of the App in breach of the law.
14. Ending your use
- By you. You can stop using Gallery at any time by uninstalling it.
- By us. We may end your licence if you break these Terms. We may also update, change or stop offering the App, or any part of it, at any time. If we stop offering the App, a version already on your phone will keep working as it is, without further updates.
- What continues. When your licence ends, you must stop using the App. Sections 7, 9.3, 11, 12, 13, 17 and 19 continue to apply.
15. Additional terms for the App Store
If you got Gallery from Apple's App Store:
- These Terms are between you and Rain Infotech only, not Apple. Rain Infotech, not Apple, is responsible for the App and its content.
- Your licence is limited to using the App on Apple devices you own or control, as allowed by the Usage Rules in Apple's Media Services Terms.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to meet any warranty that applies, you may tell Apple, and Apple will refund the purchase price of the App (if any). To the extent the law allows, Apple has no other warranty obligation for the App.
- Rain Infotech, not Apple, is responsible for handling any claim about the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
- If anyone claims that the App or your use of it infringes their intellectual property rights, Rain Infotech, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country subject to a US Government embargo or designated as "terrorist supporting", and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.
16. Changes to these terms
We may update these Terms from time to time. We'll post the new version on this page with a new "Last updated" date. Using the App after the change takes effect means you accept the updated Terms.
17. Governing law and disputes
These Terms are governed by the laws of India. Subject to consumer protection law, including the law of the country where you live, any dispute about these Terms or the App is subject to the exclusive jurisdiction of the courts in Surat, Gujarat, India.
Before taking formal action, please contact us at photogallery.securevault@raininfotech.com or through our Grievance Officer, so we can try to resolve it informally.
